Policy

Except where otherwise credited, I am the copyright © owner of all content of this website, including images.

My photography is currently a hobby, not a professsion. Meanwhile, none of the bands or musicians I photograph are in the 'megabucks' league, and indeed a major motivation for running this site and doing the other things I do is to help these artists by raising their visibility on the Internet and helping to get their music known to more people.

I am usually chuffed to see gig photos of mine used on CD/DVD covers/booklets, others' websites or promotional materials, etc, or signalling photos published in rail magazines.

Therefore, subject to the caveat below, I am happy for others to copy and use photos or any other material from this website without payment, providing I am credited (see below) and my works are only used for

  1. personal, academic or any other not-for-profit purposes, or
  2. the benefit of the bands, musicians, gig venues, small record labels or other independent organisations involved in the promotion, distribution or retailing of these artists and their recordings and performances (gig photos); or railway heritage organisations, rail publications, etc (signalling photos).

The only limitation I place on the above is that, in the event of a 'major windfall' scenario such as where a CD whose cover or booklet includes photos of mine then becomes a major commercial success, I would expect to receive some retrospective payment in proportion to the scale of profits made and at least comparable to what a commercial photographer would have earned had the work been done under standard commercial arrangements for a major, established corporation.

The above does not extend to publicly quoted companies or other large, profit-making corporations (including wholly- or majority-owned subsidiaries of these), though I often do grant permission for such companies to use my photos on a case-by-case basis.

If you'd like to use my photos but do not believe you are covered by the terms described above, or are not sure, just contact me and I'll be very happy to discuss.


Paternity rights

'Paternity rights' are the right of a copyright owner to be credited where his/her work is used in someone else's publication.

I expect all uses of my photos to be accompanied by a suitable credit, except where this is clearly impracticable or would significantly distract from the purpose of the publication (eg on some band/gig fliers).

Please use the name Adrian the Rock when giving credit. If the publication is in electronic form, eg on a website or in HTML-formatted emails, please hyperlink the credit back to this site, ie http://www.roscalen.com, if possible.


Higher-resolution image files

In most cases I have higher-resolution copies of photos available. I keep recent photos in TIFF format at 16 bits/channel; some older ones are JPEGs. Please contact me if you are interested in obtaining any of these.


Metadata

Metadata is textual information included within image files and used to communicate additional details about the photograph, eg the date taken and additional details about the subject matter.

Since about 2006 I have included metadata in all new photos published on this site (though the older photos don't have it and, at the present moment, I have no plans to incorporate it retrospectively).

My metadata is encoded using the Adobe XMP standard, which incorporate the standard EXIF, IPTC and Dublin Core schemas and has also been adopted by the new Photo Gallery component of Microsoft's Windows Vista. I have taken advantage of XMP's extensibility to define additional items of metadata to include in my gig and railway photos, for example the name of the band/artist or the signalboxes controlling the signals shown in the photo. These pages also include custom metadata panels for Adobe Photoshop which you can download and install to allow my custom metadata to be easily viewed in Photoshop and Bridge.
